End User License Agreement
1. Parties and acceptance
This Agreement is between you and Triad Solutions, a company based in Gothenburg, Sweden ("we", "us"). By creating an account, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, do not use the App.
2. License grant
We grant you a personal, non-transferable, non-sublicensable, revocable license to use Who's In on any Apple- or Google-branded device that you own or control, solely for your personal, non-commercial purposes, subject to the App Store / Play Store usage rules and this Agreement.
3. Eligibility
You must be at least 16 years old, or the age of digital consent in your jurisdiction, whichever is higher. You confirm you are not a person barred from using the App under the laws of your country of residence.
4. Your account
- You are responsible for keeping your account credentials confidential.
- You must provide accurate sign-up information.
- You are responsible for activity under your account.
- You may delete your account at any time from Settings → Data & Privacy.
5. Paid features (one-time fee per session)
- The session fee is a one-time consumable in-app purchase. Pricing is set by tier (group size) at the moment of payment, in the currency of your App Store / Google Play account.
- The 5-day free period is operated by us inside the App; it is not a StoreKit free trial. After 5 days an unpaid session becomes read-only; it can be reactivated by purchasing the fee within 90 days.
- No refunds from us. All purchases are processed by Apple or Google; refund requests must be submitted to them under their refund policies.
- Upgrades. If your group outgrows the tier you paid for, the upgrade is a separate consumable purchase for the tier delta.
We do not process payments between members. "Settle up" buttons open Swish or Venmo deep links with prefilled amounts; the actual transfer happens in your bank or wallet app, outside of Who's In.
6. User-generated content
You retain ownership of content you post in the App (messages, photos, captions, expense descriptions). By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit your content solely as required to operate the App and only to other members of the same session.
6.1 Acceptable use
You agree not to upload, post, or transmit content that:
- Is unlawful, defamatory, harassing, threatening, obscene, hateful, or invasive of another's privacy.
- Infringes another party's intellectual property or other rights.
- Contains malware or attempts to disrupt or compromise the App.
- Impersonates any person or misrepresents your affiliation.
- Solicits, advertises, or sells goods or services unrelated to the trip or party the session is about.
6.2 Reporting and moderation
Any user can report a message or photo by tapping "Report" on it. The session's organizer and co-organizer can review reports and remove content. Repeat or severe violations may result in account suspension.
6.3 Blocking
Any user may block another user. Blocked users' content is hidden from the blocker.
7. No tolerance for objectionable content
We do not tolerate objectionable content or abusive behavior. We will respond to reports filed in-app within 24 hours, and may remove content and suspend the responsible account.
8. AI features
The App includes AI-powered features (itinerary builder, date picker, budget suggester, activity recommender, chat assistant). These features:
- Are provided "as is" — output may be inaccurate, incomplete, or inappropriate, and you must independently verify any information you rely on (especially budgets, dates, and travel logistics).
- Pass session content you submit to a third-party AI provider for inference; see the Privacy Policy for details.
- Are subject to daily usage caps to control cost and abuse.
9. Intellectual property
The App, its design, code, and trademarks are owned by Triad Solutions or its licensors and are protected by Swedish and international intellectual property laws. Nothing in this Agreement transfers any of those rights to you.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
To the maximum extent permitted by law, in no event will Triad Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the App. Our aggregate liability for any claim arising from this Agreement or your use of the App will not exceed the amount you paid us in the twelve months preceding the claim.
Nothing in this section limits liability that cannot lawfully be excluded under Swedish or EU consumer law.
12. Indemnity
You agree to indemnify and hold harmless Triad Solutions from any claim, demand, or damages arising out of (a) your use of the App in violation of this Agreement, (b) your User-Generated Content, or (c) your violation of any third-party right.
13. Apple-required terms
- Acknowledgement. You acknowledge that this Agreement is between you and Triad Solutions, not with Apple, and that Apple is not responsible for the App or its content.
- Scope of license. The license in §2 is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms.
- Maintenance and support. Triad Solutions is solely responsible for maintenance and support; Apple has no obligation to furnish any.
- Warranties. In the event of failure to conform to applicable warranty, you may notify Apple, which will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Product claims. Triad Solutions, not Apple, is responsible for addressing any claims by you or a third party relating to the App.
- Intellectual property claims. In the event of a third-party claim that the App infringes intellectual property rights, Triad Solutions, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not in a country subject to a U.S. Government embargo, and not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it.
14. Termination
We may suspend or terminate your account if you violate this Agreement, abuse other users, or use the App in a way that creates liability for us or other users. You may terminate at any time by deleting your account.
15. Changes
We may update this Agreement. Material changes will be announced in-app at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
16. Governing law and disputes
This Agreement is governed by the laws of Sweden, without regard to conflict-of-laws principles. The courts of Gothenburg, Sweden have exclusive jurisdiction, except where mandatory consumer-protection laws of your country of residence apply.
